These Terms & Conditions (the “Terms”) govern your access to and use of gwongtherapy.ca (the “Site”) and any purchase you make from Gwong Therapy (“Gwong Therapy,” “we,” “us” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

The Site is hosted on Shopify Inc. Your use of the Site is also subject to Shopify’s terms where applicable.

3. Accounts

You may need to create an account to place orders. You are responsible for keeping your login details confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or close accounts that violate these Terms.

4. Products, descriptions & availability

• We try to display our products, colours and details as accurately as possible, but we cannot guarantee that your device’s display is accurate, and slight variations may occur.
• All products are subject to availability. We may limit quantities, and we may change, discontinue or stop selling any product at any time without liability to you.
• Occasionally items may be out of stock after an order is placed; if so, we will notify you and offer a replacement, backorder or refund.

5. Pricing, currency & taxes

• Prices are listed in Canadian dollars (CAD) unless stated otherwise, and are subject to change without notice.
• Applicable taxes (such as GST/HST or PST/QST, depending on your province) and any shipping charges are calculated and shown at checkout.
• Despite our best efforts, a product may occasionally be mispriced. If a product’s correct price is higher than the price shown, we may cancel the order or contact you for instructions before shipping.

6. Orders & acceptance

Your order is an offer to purchase. An order confirmation email acknowledges that we received your order; it does not mean we have accepted it. We reserve the right to accept, refuse or cancel any order at our discretion — for example, in cases of suspected fraud, pricing errors, or stock issues. Where we cancel a paid order, we will refund the amount charged.

7. Payment

• Payments are processed through Shopify Payments and/or third-party payment processors. By providing payment information, you represent that you are authorized to use the payment method.
• We may use fraud-screening tools and may cancel orders that fail verification.
• We accept the payment methods shown at checkout (which may include cards, Shop Pay, PayPal, Apple Pay, Google Pay, Interac and, where offered, cash on delivery or instalment options).

8. Shipping & delivery

We ship across Canada. Shipping costs, methods and estimated delivery times are shown at checkout and described in our Shipping & Returns page. Delivery estimates are not guaranteed and delays may occur due to carriers or events outside our control. Risk of loss passes to you on delivery. Please review our Shipping & Returns policy, which forms part of these Terms.

9. Returns, refunds & exchanges

Our Returns, Refunds & Exchanges policy — including our 30-day money-back guarantee and 1-year warranty — is described on our Returns page and forms part of these Terms. Your statutory consumer rights under applicable provincial law are not affected.

10. Promotions, discount codes & free gifts

• Promotions, discount codes and bundle offers (such as “Buy One, Get One”) are subject to their stated terms, may be time-limited, and may be changed or withdrawn at any time.
• Free gifts (such as the Skincare Starter Kit) are subject to availability; we cannot provide a cash alternative or a substitute of the same retail value.

11. Product use & safety disclaimer

Important — please use our devices as directed. Gwong Therapy LED masks and skincare products are intended for general cosmetic and skincare use only. They are not medical devices and nothing on the Site is medical advice or a substitute for professional care.

• Always follow the included instructions. Keep your eyes closed during light sessions and perform a patch/sensitivity test before first use.
• Do not use if you are pregnant or breastfeeding, have a photosensitive condition, take photosensitising medication, or have certain eye conditions, without first consulting a healthcare professional. Discontinue use and seek advice if you experience irritation or discomfort. [Confirm full contraindications with the manufacturer.]
• If you have a medical condition or concern about your skin, consult a qualified healthcare professional before use.

12. Intellectual property

The Site and its content — including text, graphics, logos, images, and the “Gwong” and “Gwong Therapy” names and marks — are owned by us or our licensors and are protected by law. We grant you a limited, personal, non-transferable licence to use the Site for shopping. You may not copy, reproduce or use our content or marks without our written permission.

13. Reviews & user content

If you submit reviews, photos, comments or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce that content in connection with our business. You are responsible for your content and must not post anything unlawful, misleading, infringing or offensive. We may remove content at our discretion.

14. Third-party links

The Site may link to third-party websites or services we do not control. We are not responsible for their content, policies or practices. Accessing them is at your own risk.

15. Disclaimers

Except as required by applicable law (including provincial consumer-protection legislation), the Site and products are provided “as is” and “as available,” and we disclaim all warranties not expressly stated. Some jurisdictions do not allow certain disclaimers, so some may not apply to you; nothing in these Terms limits rights that cannot be limited under applicable law.

To the maximum extent permitted by applicable law, Gwong Therapy will not be liable for any indirect, incidental, special or consequential damages, and our total liability for any claim relating to a product or order will not exceed the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Canadian law, including your rights under provincial consumer-protection legislation.

You agree to indemnify and hold harmless Gwong Therapy and its owners, employees and suppliers from any claims, losses or expenses arising out of your breach of these Terms or your misuse of the Site or products, to the extent permitted by law.
